AI on the Docket is a three-part CLE series examining the practical, ethical, and strategic dimensions of using artificial intelligence in the practice of law. The series is designed to give attorneys — in private practice and in-house alike — a working knowledge of current AI tools, the professional responsibility issues they raise, and how to deploy them competently and ethically across litigation, transactional, arbitration, and corporate legal settings.

Duty, Diligence, and the Digital Age
This session examines the intersection of legal ethics and artificial intelligence as the use of AI becomes ubiquitous in the practice of law. Topics include the ethical ramifications and potential sanctions that may result from the improper use of AI, including the submission of hallucinated citations in court filings; confidentiality, privilege, and data security concerns raised by the use of generative AI platforms, including the potential waiver of privilege when using AI tools like ChatGPT and Claude. This course also examines practical measures attorneys may adopt to safeguard confidentiality and privilege, including prohibitions on client uploads of work product to public AI platforms and the incorporation of AI-specific provisions into engagement letters. Finally, the panel will explore ethical considerations surrounding AI’s physical infrastructure, including the substantial demands associated with data centers and responsible technology procurement.
